Yelš³low cab and Uber drivers who strike a pź¦ edestrian or cyclist with the right of way would only be hit with a summons under a new bill that passed the state Senate on Tuesday.
A law creaź§ted last year under Vision Zero, Mayor Bill de Blasioās pš¬lan to end traffic deaths, made it a misdemeanor for such drivers if the injuries are critical or fatal.
Sen. Martin Dilan introduced legislation that he said was meant to protect bus drivers ā buź¦t the city says it wašs written so broadly, any for-hire vehicle driver is exempt.
āThis preferential treatment would be extended to the operators of taxis, livery cars, paratransit vehicles, privaš te bus companies, commuter vans, and any other vehicles used to transport passengers for hires,ā wrote Sherif Soliź©µman, a city director of state legislative affairs, in a memo opposing the bill.
Both the NYPD and de Blasioās administration oppose the legislation, accordingą² to a spokesman for thš§e mayor.
āIt would drastically weaken protections for New Yoārk Cityās pedestrians,ā said spokesman Wiley Norvell. āIt would seriously impede the investigation and decision-making of police officers.ā
The bus drivers’ union said the only change was how drivers are treated by cops.
āIt is still a misdemeanor with the same penalties ā potential fines and jail,ā said Peteš§ Donohue, a spokesman for transit workers union TWU Local 100, which isš¼ backing the bill.
āThe only difference is you are not cuffed like a thug and treated like a thug for an uš¦nintentioź¦nal accident that doesnāt involve recklessness on the part of the driver.ā
A mother whose son, Coopešr Stock, was killed in a crosswalk by a yellow cab in Manhattan was outraged āabout the legislation, and said neither bus nor cab drivers should be exempt.
āItās absolutely outrageous,ā said Dana Lerner of the grouš·p Families for Safe Streets, noting her disgust that the United Federation of Teachers backed the bill. āThere is no reason anyone should be exempt.ā
TWU Local 100 said tšÆhey were criminalized under Vision Zero.
āThe bill addresses oušr objection to bus operators being handcuffed at the scene of an accident and hauled away to a police holding cell like common criminals,ā said TWU Local 100 in a statement, which added that the MTA needs to redraw routes that eliminate left turns at risky intersections.
āIšÆt also complš ies with the intent of the Vision Zero law.ā
