Freed NYC burglar sexually assaults sleeping mom, NYPD sources say

A burglar busted for breaking into a Brooklyn Heights building, but released because the charge wasn’t bail eligible — broke into a nearby apartment where he sexually assaulted a sleeping mom eight days later, police sources told The Post.

The first crime happened around 3:30 a.m. on May 4 on Joralemon Street when Jayquan Martinez allegedly jimmied open a building’s basement door and rifled through three Amazon packages, removing some items, cops said.

He was nabbed for criminal trespass when he returned to the building on May 8 for unknown reasons, and cops realized he was the 🍷burglar, the sources said.

Martinez, 27, was hit with 14 charges, including felony🧸 burglary.

Brooꦛklyn Criminal Court Judge Germaine Auguste released Martinez, who allegedlyဣ broke in through the basement, with only an order of protection, despite a prior burglary rap from August 2017, the sources said.

Then, at 12:30 a.m. on May 12, he allegedly broke into a different apartment building in the neighborhood, near Middagh Street and Henry Street, climbed into a 49-year-old stranger’s bed, and began “kissing her intimate parts,” police sources said.

The victim’s 8-year-old son was sleeping in another room.

“She screamed and he backed out,” a policeꦗ source sa🦩id.

Martinez allegedly fled the location with the victim’s wallet, including her cash and credit cards.

She wasn’t injured, cops said.

A resident of the Joralemon⭕ Street building burglarized on May 4 was stunned Martinez had been roaming the streets after his arrest.♎

“That’s terrible, absolutely terrible,” said the 37-year-old man, who asked to remain anonymous out of fear for his safety. “I don’t want him to come back.”

He continued: “A person like that should stay arrested and be in jail. It’s ab෴solutely shocking that it was the same guy.”

The day after the sex attack, Martinez allegedly broke into a Volvo in the area and stole 14 credit cards, checks, a laptop and cash, the sourꦇces said.

Martinez was arrested on Wednesday — after cops identified him through video surveillance — and charged with burglary, attempted criminal sexual act, criminal possession of stolen property, attempted sexual misconduct and endangering the welfare of a child, according to the NYPD.

Martinez, who police records show has a history as an♊ emotionally disturbed person, was sent to Methodist Hospital for a psychiatric evaluation, the sources said.

Auguste was first appointed as an interim Civil Court judge in August 2021 under Mayor Bill de Blasio. She was 🔜reappointed to criminal court by Mayor Adams last year.

She previously served as a public defender with The Legal Aid Society in Quee🃏ns for 30 years, according to her bio.

A message left with her husband wasn’t returned.

One police source said Martinez should have been held until his next court date on July 31 because of his prior burglary, but judges aren’t allowed to consider dangerousness as a factor when determining bail.

“Despite what all the advocates say, time and time again we see the same people committing the same dangerous offenses over and over again,” the source said. “When are we going to realize that the advocates are wrong?”
